Demand Full Federal Legalization and Decriminalization of Marijuana in the United States

Target: President of the United States, U.S. Congress, and the Drug Enforcement Administration (DEA)

Goal: Urge the President, Congress, and the DEA to fully legalize and decriminalize marijuana at the federal level, expunge past convictions, and respect state-level legalization efforts.

Despite growing public support and widespread state-level legalization, marijuana remains a federally controlled substance, criminalized under outdated laws. Recent discussions about rescheduling marijuana are a step forward, but they fall short of the comprehensive reform needed to address social justice, public health, and economic opportunity.

The federal classification of marijuana as a Schedule I drug is out of step with scientific research, public opinion, and the lived realities of millions of Americans. While the Biden and Trump administrations have considered rescheduling marijuana to Schedule III, this change would not legalize or decriminalize marijuana, nor would it end the harms caused by decades of prohibition.

Rescheduling would recognize medical uses and potentially ease research restrictions, but it would still subject marijuana to federal control and criminal penalties. Meanwhile, communities—especially communities of color—continue to suffer from the disproportionate impacts of marijuana criminalization. Businesses face punitive tax burdens, and patients are denied access to needed medicine.

Over half of U.S. states have legalized marijuana in some form, and nearly half allow recreational use. Yet federal law continues to undermine state policies, threaten civil liberties, and block economic opportunities. Congress must act to end federal prohibition, expunge past convictions, and allow states to set their own policies without interference.

We call on federal leaders to enact comprehensive marijuana reform that prioritizes justice, equity, and public health.
